Insolvency and restructuring
The office provides legal counsel, assistance and representation at every stage of insolvency proceedings, for both debtors and creditors, in accordance with the provisions of Law no. 85/2014 on insolvency prevention procedures and insolvency proceedings.
Assistance for the debtor:
- The stage preceding the opening of insolvency proceedings;
- Drafting and filing the application for the opening of insolvency proceedings;
- Challenging the state of insolvency alleged by a creditor;
- Assistance regarding the effects of the opening of the proceedings and the debtor's rights;
- Conduct of the general insolvency or bankruptcy procedure;
- Drafting and proposing a reorganisation plan, as well as assistance in its implementation;
- Filing applications to hold the directors or the members of the management bodies personally liable;
- Representation in all challenges and applications made in the course of the insolvency proceedings.
Assistance for the creditor:
- Preparing, drafting and filing the application for the opening of insolvency proceedings against a debtor;
- Intervention in insolvency proceedings opened at the request of the debtor or of other creditors;
- Filing objections against the opening of insolvency proceedings;
- Protecting the creditor's rights and interests throughout the proceedings, by lodging challenges, applications and other legal steps.
The office ensures a strategic approach, adapted to each situation, with the aim of protecting the client's interests and identifying the most effective legal solutions, whether in the reorganisation of the business or in the recovery of claims.
